The Probate Fee is a fee payable from the estate to the Provincial Government of British Columbia before a Grant of Probate can be issued by the courts.
The Probate Fee is calculated as follows:
• Basic Fee $200
• 0.6% on the value of the estate between $25,000 - $50,000
• 1.4% on the value of the estate over $50,000
There is no Probate Fee for estates with a value of less the $25,000.
The "value of the estate" is defined as the gross value, of:
• the real estate and tangible (physical) personal property in British Columbia, and
• if the deceased was a resident of British Columbia, the intangible personal property of the deceased, wherever situated (i.e banks accounts and investments).
An estate of $1,000,000 would pay $13,650.00.
